Myron M. Cherry & Associates filed a lawsuit today against JIMMY JOHN’S® Sandwich Shops for allegedly failing to pay minimum wage and overtime to its Assistant Store Managers in violation of Federal and state laws.  The suit also seeks to invalidate the Company’s Confidentiality and Non-Competition Agreement that it requires its employees to sign as a condition of employment, which significantly, if not completely, impairs the employee’s ability to find subsequent employment.  The case seeks class action status and was brought not only against the corporate parent of JIMMY JOHN’S®, but also against a putative class of all JIMMY JOHN’S® franchisees.
